Condiciones de uso de Luneyo

Estas condiciones explican cómo funciona Luneyo, qué puedes esperar y qué te pido a cambio. Están escritas para leerse. Si algo no se entiende, escríbeme a [CORREO DE CONTACTO].

1. Quién presta el servicio

Luneyo lo hace y lo ofrece [NOMBRE Y APELLIDOS], con NIF [NIF] y domicilio en [DIRECCIÓN POSTAL], España (en estas condiciones, "Luneyo" o "yo"). Contacto: [CORREO DE CONTACTO].

2. Qué es Luneyo y quién puede usarlo

Luneyo es un diario personal: cuentas tu día en voz alta o por escrito, Luneyo lo pasa a texto, lo ordena y lo guarda en tu móvil junto a tus fotos y vídeos.

Para usar Luneyo tienes que ser mayor de 18 años. Al usar la app aceptas estas condiciones y la política de privacidad.

3. Tu diario es tuyo

Todo lo que guardas en Luneyo (texto, voz, fotos, vídeos) es tuyo. Luneyo no se queda con ningún derecho sobre ello.
Cuando usas la IA en la nube, me das permiso para procesar lo que envías solo para darte el servicio (transcribirlo, escribirlo, responderte) y en la forma que explica la política. Ese permiso termina en cuanto la respuesta vuelve a tu móvil: el servidor no lo guarda.
Nunca uso tu diario para entrenar modelos de IA, ni para publicidad, ni lo vendo.
Los textos que la IA escribe para ti a partir de tu diario también son tuyos para usarlos como quieras.

4. La IA puede equivocarse

Luneyo usa modelos de IA, en tu móvil o en la nube, para transcribir, escribir, resumir y responder. Pueden oír mal una palabra, confundir un nombre o escribir algo que no pasó. Revisa lo que guardas. Cada respuesta a tus preguntas te enseña los recuerdos de los que sale, para que puedas comprobarla.
Luneyo no es un servicio de salud, ni psicológico, ni legal, ni financiero, y lo que escribe no es un consejo profesional.
Luneyo no es un servicio de emergencias y nadie lee tu diario. Si estás pasando un mal momento o temes por tu vida o la de otra persona, llama al 112. En España, la línea de atención a la conducta suicida es el 024, gratuita y a cualquier hora.

5. Lo que te pido

Usa Luneyo para tu diario personal, conforme a la ley.
Respeta a los demás: si grabas a otra persona o guardas fotos suyas, que sea con su permiso; si activas "Caras en tus fotos", no etiquetes a nadie que no quiera.
No intentes saltarte los límites de uso, los pagos ni la seguridad del servicio (por ejemplo, llamando al servidor sin la app, creando instalaciones en masa o modificando la app), ni usar el servidor para otra cosa que Luneyo.
No uses la IA de Luneyo para crear contenido ilegal o para hacer daño a otras personas.

Si alguien abusa del servicio, puedo cortar el acceso a la nube de esa instalación. Lo que funciona en el móvil sigue funcionando.

Gratis, sin límite de recuerdos: todo lo que funciona en el móvil (la voz, la escritura y las preguntas con los modelos del móvil, la búsqueda, el calendario, el mapa, el Wrapped del mes, los álbumes, los propósitos, el bloqueo y las copias).

Luneyo Plus es una suscripción que añade la IA en la nube y lo que se hace para ti. La lista actual está en la pantalla de Luneyo Plus de la app; lo que todavía no existe aparece como "Próximamente" y no forma parte de lo que pagas hasta que llegue.

Precio: el que ves en Google Play en el momento de suscribirte, con IVA incluido. Hay plan mensual y plan anual.
Pago y renovación: lo cobra Google Play con tu cuenta de Google. La suscripción se renueva sola al final de cada periodo hasta que la canceles.
Cancelar: cuando quieras, en Google Play > Pagos y suscripciones. Sigues teniendo Plus hasta el final del periodo pagado y no se renueva. Si desinstalas la app, la suscripción no se cancela sola.
Cambios de precio: si el precio de Plus cambia, te avisaré con antelación y Google Play te lo pedirá aceptar o te dará la opción de cancelar, según sus normas. Nunca se cambia el precio de un periodo ya pagado.
Prueba de 7 días: Plus completo durante 7 días, sin tarjeta, desde tu primer recuerdo. Al acabar vuelves a la versión gratis y no se cobra nada. Una prueba por instalación.
Uso razonable: la nube cuesta dinero en cada uso, así que Plus incluye cada mes unos minutos de voz y unas preguntas en la nube, y un máximo de preguntas al día. Las cifras de cada momento están en la pantalla de Luneyo Plus y en Ajustes. Si llegas al tope, nada deja de funcionar: la voz y las preguntas pasan a los modelos del móvil hasta el mes siguiente, y la app te lo dice. Si alguna vez bajo esos topes, te avisaré con al menos 30 días.

7. Oferta de fundador

Quien completa la experiencia de luneyo.app recibe un código de fundador.
Con ese código, Luneyo Plus cuesta la mitad del precio normal de su plan (mensual o anual) vigente cuando te suscribes, y ese precio se mantiene mientras mantengas la suscripción activa sin cortarla.
Un código por persona y por suscripción. La oferta tiene 300 plazas y termina el 31 de enero de 2027 o antes si se acaban. Las plazas las cuenta el servidor.
Si cancelas y la suscripción termina, pierdes el precio de fundador. Si la oferta sigue abierta, puedes volver a usar tu código; si ya cerró, no.
El código no da Plus por sí solo: hace falta suscribirse. Tiene los mismos topes de uso razonable que Plus.
El código no se puede vender ni cambiar por dinero.

8. Tus derechos como consumidor

Tienes todos los derechos que te da la ley de consumidores. Nada de estas condiciones los limita.
Desistimiento: al suscribirte y empezar a usar Plus en el momento, pides que el servicio empiece ya. Si desistes dentro de los 14 días siguientes a la compra, tienes derecho a que se te devuelva el importe, descontando la parte proporcional del servicio que ya hayas recibido. Para pedirlo, escríbeme a [CORREO DE CONTACTO] o pídelo en Google Play (Google Play tiene además su propia política de reembolsos).
Si algo no funciona como prometo, escríbeme y lo arreglo o te devuelvo lo que corresponda.

9. Disponibilidad y cambios en la app

Lo que funciona en el móvil no depende de mí ni de internet.
La IA en la nube puede pausarse un rato por mantenimiento, por un fallo de un proveedor o si el gasto del día llega a su tope de seguridad. Mientras tanto la app sigue con los modelos del móvil.
Luneyo va a cambiar: añadiré cosas y puede que quite alguna. Si quito algo importante de Plus, te avisaré antes y, si ya no te compensa, podrás cancelar.

10. Copias y pérdida de datos

Tu diario vive en tu móvil. Si pierdes el móvil, lo rompes o desinstalas la app sin copia, yo no puedo recuperarlo, porque no lo tengo. Haz copias con la opción de copia de la app (Luneyo te lo recuerda) y guárdalas en un sitio seguro.

11. Responsabilidad

Hago lo posible para que Luneyo funcione bien y cuide tus datos, pero es un programa y puede tener fallos.
No respondo de los daños que vengan de usar Luneyo en contra de estas condiciones, de no hacer copias, de lo que escribas en tu diario o de fallos de servicios de terceros (Google Play, tu móvil, los proveedores de IA o de mapas) que no dependan de mí.
Nada de esto limita mi responsabilidad cuando la ley no lo permite: por ejemplo, por dolo o culpa grave, por daños a las personas o frente a tus derechos como consumidor.

12. Propiedad intelectual

La app, la marca Luneyo, el diseño y los textos de la app son de [NOMBRE Y APELLIDOS]. Puedes usar la app para ti; no puedes copiarla, venderla ni hacer otra a partir de ella.
Luneyo usa software libre con sus licencias. Los modelos que descargas en la app tienen las suyas (por ejemplo, Apache 2.0), que aceptas al descargarlos.
Los mapas usan datos de OpenStreetMap y de Esri, con sus atribuciones. La búsqueda de canciones usa Spotify y se rige también por sus condiciones.

13. Fin

Puedes dejar de usar Luneyo cuando quieras: desinstala la app y cancela la suscripción en Google Play si la tienes. Si dejo de ofrecer Luneyo, te avisaré con al menos 60 días, la app seguirá funcionando en el móvil con lo que funciona sin conexión y podrás exportar todo.

14. Cambios en estas condiciones

Si cambio algo importante, te avisaré en la app al menos 30 días antes. Si no estás de acuerdo, puedes cancelar antes de que se aplique.

15. Ley y tribunales

Estas condiciones se rigen por la ley española. Si hay un conflicto, intentemos resolverlo hablando: escríbeme a [CORREO DE CONTACTO]. Si no es posible, como consumidor puedes acudir a los tribunales de tu domicilio, o a las juntas arbitrales de consumo si yo me adhiero a ellas.

Luneyo Terms of Use

These terms explain how Luneyo works, what you can expect and what I ask in return. They are written to be read. If something is unclear, write to [CONTACT EMAIL].

1. Who provides the service

Luneyo is made and offered by [FULL NAME], tax ID [TAX ID], address [POSTAL ADDRESS], Spain ("Luneyo" or "I" in these terms). Contact: [CONTACT EMAIL].

2. What Luneyo is and who can use it

Luneyo is a personal diary: you tell your day out loud or in writing, and Luneyo turns it into text, sorts it and keeps it on your phone next to your photos and videos.

You must be 18 or older to use Luneyo. By using the app you accept these terms and the privacy policy.

3. Your diary is yours

Everything you keep in Luneyo (text, voice, photos, videos) is yours. Luneyo takes no rights over it.
When you use cloud AI, you allow me to process what you send only to provide the service (transcribe it, write it, answer you) and as the privacy policy explains. That permission ends when the answer is back on your phone: the server does not keep it.
I never use your diary to train AI models, for advertising, or sell it.
The texts the AI writes for you from your diary are also yours to use as you like.

4. AI can be wrong

Luneyo uses AI models, on your phone or in the cloud, to transcribe, write, recap and answer. They can mishear a word, mix up a name or write something that did not happen. Check what you keep. Every answer to your questions shows the memories it comes from, so you can verify it.
Luneyo is not a health, psychological, legal or financial service, and what it writes is not professional advice.
Luneyo is not an emergency service and nobody reads your diary. If you are going through a hard time or fear for your life or someone else's, call 112 (EU) or your local emergency number. In Spain, the suicide prevention line is 024, free and around the clock.

5. What I ask of you

Use Luneyo for your personal diary, within the law.
Respect others: if you record someone or keep their photos, do it with their permission; if you turn on "Faces in your photos", do not tag anyone who would not want it.
Do not try to get around usage limits, payments or the security of the service (for example, calling the server without the app, creating installs in bulk or modifying the app), or use the server for anything other than Luneyo.
Do not use Luneyo's AI to create illegal content or to harm others.

If someone abuses the service, I may cut cloud access for that install. What runs on the phone keeps working.

6. Free and Luneyo Plus

Free, with no limit on memories: everything that runs on your phone (voice, writing and questions with on-device models, search, calendar, map, monthly Wrapped, albums, purposes, lock and backups).

Luneyo Plus is a subscription that adds cloud AI and the things made for you. The current list is on the Luneyo Plus screen in the app; what does not exist yet is shown as "Coming soon" and is not part of what you pay for until it arrives.

Price: the one shown in Google Play when you subscribe, VAT included. There is a monthly and a yearly plan.
Payment and renewal: charged by Google Play through your Google account. The subscription renews automatically at the end of each period until you cancel it.
Cancel: any time, in Google Play > Payments and subscriptions. You keep Plus until the end of the paid period and it does not renew. Uninstalling the app does not cancel the subscription.
Price changes: if the price of Plus changes, I will tell you in advance and Google Play will ask you to accept it or give you the option to cancel, under its rules. The price of a period already paid never changes.
7-day trial: full Plus for 7 days, no card, from your first memory. When it ends you go back to the free version and nothing is charged. One trial per install.
Fair use: the cloud costs money with every use, so Plus includes some cloud voice minutes and questions each month, and a daily maximum of questions. The current numbers are on the Luneyo Plus screen and in Settings. If you reach a cap, nothing stops working: voice and questions move to the on-device models until the next month, and the app tells you. If I ever lower those caps, I will tell you at least 30 days before.

7. Founder offer

Whoever finishes the experience at luneyo.app receives a founder code.
With that code, Luneyo Plus costs half the normal price of its plan (monthly or yearly) in force when you subscribe, and that price stays for as long as you keep the subscription active without a break.
One code per person and per subscription. The offer has 300 places and ends on 31 January 2027, or earlier if they run out. The server counts the places.
If you cancel and the subscription ends, you lose the founder price. If the offer is still open, you can use your code again; if it has closed, you cannot.
The code does not give Plus on its own: you need to subscribe. It has the same fair use caps as Plus.
The code cannot be sold or exchanged for money.

8. Your rights as a consumer

You have every right consumer law gives you. Nothing in these terms limits them.
Withdrawal: by subscribing and starting to use Plus right away, you ask for the service to start immediately. If you withdraw within 14 days of the purchase, you are entitled to a refund minus the proportional part of the service you have already received. To ask, write to [CONTACT EMAIL] or request it in Google Play (Google Play also has its own refund policy).
If something does not work as promised, write to me and I will fix it or refund what is due.

9. Availability and changes to the app

What runs on your phone does not depend on me or on the internet.
Cloud AI may pause for a while for maintenance, a provider failure, or if the day's spending reaches its safety cap. Meanwhile the app keeps going with the on-device models.
Luneyo will change: I will add things and may remove some. If I remove something important from Plus, I will tell you first and, if it is no longer worth it to you, you can cancel.

10. Backups and data loss

Your diary lives on your phone. If you lose the phone, break it or uninstall the app without a backup, I cannot recover it, because I do not have it. Make backups with the app's backup option (Luneyo reminds you) and keep them somewhere safe.

11. Liability

I do my best for Luneyo to work well and to look after your data, but it is software and can fail.
I am not liable for damage that comes from using Luneyo against these terms, from not making backups, from what you write in your diary, or from failures of third-party services (Google Play, your phone, AI or map providers) outside my control.
None of this limits my liability where the law does not allow it: for example, for intent or gross negligence, for personal injury, or against your rights as a consumer.

12. Intellectual property

The app, the Luneyo brand, the design and the app's texts belong to [FULL NAME]. You may use the app for yourself; you may not copy it, sell it or build another app from it.
Luneyo uses open-source software under its licences. The models you download in the app have their own (for example, Apache 2.0), which you accept when you download them.
Maps use data from OpenStreetMap and Esri, with their attributions. Song search uses Spotify and is also subject to its terms.

13. Ending

You can stop using Luneyo whenever you want: uninstall the app and cancel the subscription in Google Play if you have one. If I stop offering Luneyo, I will tell you at least 60 days before; the app will keep working on the phone with what runs offline and you will be able to export everything.

14. Changes to these terms

If I change something important, I will tell you in the app at least 30 days before. If you do not agree, you can cancel before it applies.

15. Law and courts

These terms are governed by Spanish law. If there is a dispute, let us try to solve it by talking first: write to [CONTACT EMAIL]. If that is not possible, as a consumer you can go to the courts of your place of residence, or to consumer arbitration boards if I join them.
